ThermoLet is run by me, Martin, a sole trader trading as ThermoLet. You can reach me at [email protected], and my full name and a postal address for formal correspondence are available on request. Email and ask.
These terms cover using this website and signing up, and they set out the basis on which I'd provide the service if you go on to become a host. They're written to be read, not to be impenetrable. But they are the agreement between us, so the bits that limit what I promise mean what they say.
Filling in the form registers your interest. It doesn't commit you to anything, and no payment details are taken. I'll email you to arrange a call, and you're free to walk away at any point before we set your property up. Equally, I might not be able to take you on, either because your thermostat isn't supported yet or because I've filled the spots.
I may change the price for future months. If I do, I'll email you at least 30 days before it takes effect, and you can cancel at any point before then rather than pay the new rate. A change never applies to a month you have already paid for, and it is never backdated.
If your price is fixed, this does not override that. A fixed price stays where it is for as long as you stay subscribed, whatever I charge new hosts.
ThermoLet reads your booking calendar and, around your check-in and checkout times, tells your thermostat which mode to be in: warming ahead of an arrival, back to your normal schedule while guests are in, and energy-saving when the property is empty.
It changes the mode and nothing else. It never sets a target temperature, and it never talks to your boiler directly.
If you set a temperature limit, ThermoLet also reads how warm the property is, and may put the thermostat back to its schedule while the property is above that limit. That cancels a boost, whoever put it on. If it was yours, your thermostat's app may report that someone else altered it; if a guest set it at the wall, the heating simply goes back, with no explanation to them. Leave the limit unset and it won't do this.
ThermoLet is a convenience and a cost-saving tool. It is not a frost-protection system, a property-protection system, or a safety system, and you must not rely on it as one.
If your property could be damaged by the heating failing to come on (burst pipes in a cold snap, for instance), you need protection that doesn't depend on my software, your internet connection, or a third party's servers. That might be your thermostat's own built-in frost setting, a separate monitor with an alarm, or someone checking the property. Please have one.
More specifically, I can't and don't guarantee:
You and your guests can always change the thermostat, at the wall or in your provider's own app, and ThermoLet cannot lock you out of your own heating. Treat a change as temporary, though: ThermoLet re-checks periodically and will put the thermostat back to its plan. If you want it left alone for good, disconnect it in your thermostat provider's app and it loses the ability to send any command at all, immediately.
You're responsible for keeping your booking calendar accurate and your account details up to date, and for telling me if something looks wrong. Please don't share your login.
Nothing here limits my liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow me to limit. Your rights as a consumer are unaffected by these terms.
Subject to that, and because this is a low-cost monthly subscription: my total liability to you is limited to the amount you've paid me in the 12 months before the problem arose. I'm not liable for lost income or bookings, for higher energy bills, or for property damage that reasonable precautions of the kind described above would have prevented.
If something goes wrong because of ThermoLet, tell me. I'd rather fix it and make it right than argue about a clause.
You can cancel at any time by emailing me. I may suspend or end the service if the fee goes unpaid, if the service is misused, or, with as much notice as I can reasonably give, if I stop offering ThermoLet. If I shut it down, I'll refund anything you've paid for a period you won't get.
When your account ends, ThermoLet stops sending commands and your thermostat carries on with its own schedule exactly as it would have without me.
I may update these terms. If a change materially affects you as a paying host, I'll email you before it takes effect, and you can cancel if you don't like it. The date at the top always reflects the current version.
These terms are governed by the law of England and Wales, and disputes go to the courts of England and Wales. If you live in Scotland or Northern Ireland, you can bring proceedings in your own courts.
